Terms of Service

1. The service

Duchamp (the “Service”) is a library of templates (prompts) that you hand to an AI to make content. On the web you can browse templates, fill in their blanks and copy them or download them as .md files; in AI tools such as Claude or ChatGPT you can search and use templates directly over MCP. What the Service provides is the templates written by the operator; the content itself is made in the AI tool you choose.

The following features are no longer provided as of 26 September 2026: brand profiles, content generation inside the Service, scheduling and publishing, connecting channels (Threads, Instagram), performance tracking, browsing and saving reference posts, the pre-sign-up preview (/try), the caption and topic generators, and pre-sales diagnoses. Data you left while using those features is retained as described in the privacy policy, and you may ask us to export or delete it.

2. Fees

• Free: browse every template; copy or download .md files up to 2 times per day (Korea Standard Time). No sign-in is required, and templates retrieved over MCP in AI tools count toward the same 2 per day.
• Creator: US$9 per month or US$79 per year (tax excluded). No daily limit on copies, downloads or MCP use, and access to every template, including new ones published weekly.

Current status: payments are not open yet and no daily limit is applied. Everyone uses the Service free of charge without limits. We will announce the daily limit or the paid plan on the pricing page, and by email to registered users, at least 14 days before either starts. Free users are never moved to a paid plan automatically.

Once payments open, payment for paid subscriptions is handled by Paddle as Merchant of Record. Paddle processes payments, receipts, sales tax and refunds; responsibility for providing the Service remains with us. Checkout may show the amount converted to your local currency (Korean won in Korea). Subscriptions renew automatically and can be cancelled at any time before the next billing date. Refunds are governed by the refund policy.

3. Accounts

• You do not need an account to browse, copy or use templates over MCP. Sign-up is by email, Google or Kakao, and you must be 14 or older.
• An account is for its owner only. You are responsible for activity in your account.
• You may delete your account at any time.

4. Rights in templates and output

• Templates: the operator holds the rights in the templates. You may freely use templates you copy or download to make your own content. You may not collect and redistribute or sell the templates themselves, or use them to build a competing template collection.
• Values you type into blanks: the brand name, confirmed details, tone and brand colours you type into a template's blanks are stored only in your browser and are not sent to our servers.
• AI output: output made with a template is produced by the AI tool you choose. We do not warrant its content, accuracy or performance, nor that it attracts copyright or that you obtain exclusive rights in it. The accuracy of facts in the output and compliance with applicable law — advertising disclosure, personal data, copyright — are the responsibility of the user who publishes it.
• Examples and evidence: rights in public posts shown as examples or evidence on template pages belong to their rights holders. Being able to see an example does not grant you a right to reuse its wording, images, video or music.
• Material you entered earlier: you keep the rights you hold in brand profiles, output and other material you entered or created earlier.

To report suspected infringement, or to request that material used as an example or evidence be removed from display, email the source URL and your reason to sean@notique.co. We review each request and tell you what action we take.

5. Prohibited use

• Reproducing someone else's content or infringing their rights
• Producing false or deceptive advertising, illegal content, or content that defames others
• Scraping templates in bulk, or redistributing or selling them
• Automated bulk requests, circumventing the daily limit (including by rotating cookies or accounts), or disrupting the Service

We may restrict or delete an account for a breach without prior notice.

6. No warranty

The Service is provided “as is”. We do not warrant the performance (views, engagement, sales or otherwise), accuracy or fitness for a particular purpose of the templates or of anything made with them. Engagement counts shown as evidence on template pages are values observed on external platforms or through third-party data services and vary with the time and route of observation; they do not mean the same structure will perform for your content. The behaviour and output of AI tools are the responsibility of their providers.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect loss, loss of business or loss of data arising from use of the Service. Our aggregate liability does not exceed the amount you paid us in the preceding 12 months (zero, if you paid nothing). This limit does not apply to loss caused by our wilful misconduct or gross negligence, or where the law does not allow liability to be limited.

8. Changes and discontinuation

We may change features or discontinue the Service. We give at least 30 days' notice before discontinuation and let you export your data.

9. Changes to these terms

Changes are posted on this page with an effective date. Changes unfavourable to users are emailed at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

10. Governing law

These terms are governed by the laws of the Republic of Korea, and disputes are heard by the court with jurisdiction over the operator's registered address.
